RE:= Request for the Release of Mr. Jaranbayarin Soyolt

We, “= ;Free Soyolt Alliance” NGO, wrote this letter, with the support of international human rights organizations and individuals who are in Mongoli= a, Japan, USA and Germany, to request the Chinese government to stop the grave human rights violation of Mr. Jaranbayar Soyolt, a citizen of Mongolia.

On January= 6, 2008 at the International Airport Beijing, China, Chinese authorities arres= ted Jaranbayarin Soyolt and have been holding him in detention. Government of China’s decision to do this constitutes a grave violation of Jaranbay= ar Soyolt’s human rights and freedoms provided in the Constitution of Mongolia and international treaties on human rights and freedoms.   

 

According to his wife and= three children’s request, on February 13 and March 4, 2008 the Ministry of Foreign Affairs of Mongol= ia sent note to Chinese Ambassador in Mongolia. Also the Embassy of Mongolia in Chi= na sent note twice to the Ministry of Foreign Affairs of China requesting rele= ase of Jaranbayar Soyolt. However, Chinese authorities ignored these requests and continued the detention of <= span style=3D'mso-bidi-font-weight:bold'>Jaranbayar Soyolt. Moreover, the= Chinese government did not provide any information of his whereabouts and provided = no explanation to his family members, as to why he was arrested. It is our understanding that up to date no formal charges have been brought against h= im.

 

China is a member state of the Unite= d Nation. Pursuant to Article 2 and 4 of the UN Charter, a member state has obliged to respect and … human rights and freedoms worldwide. But by detaining a citizen of Mongolia, China has seriously violated above mentioned Charter provisions. Furthermore, in 1986, China ratified the CAT. As a member state, China has pledged to uphold the CAT obligations. Article 1 of the CAT provi= des that “…any act by which severe suff= ering, whether physical or mental, is intentionally inflicted on a person for such purposes as …punishing him for an act he or a third person has commit= ted or is suspected of having committed, or intimidating or coercing him …= ; or for any reason based on discrimination of any kind, when such pain or suffe= ring is inflicted by or at the instigation of or with the consent or acquiescenc= e of a public official…” It is our strong belief that the act= ion of the Chinese government   illegally arresting Jaranbayar Soyolt and detaining him more than 3 month constitutes a torture and inhuman treatment under Article 1 of the CAT. Thus, the Chinese government violated= its commitment to follow the CAT.     

 

Therefore, we strongly demand that t= he government of China to take urgent action to release, Jaranbayar Soyolt, the citizen of Mongolia immediately. Only this action could be consistent with Chinese obligation mandated according to the United Nations Charter and the CAT.
